The only way you did something illegal is if you retreated your air units somewhere, and then moved them to S. Italy.

If the sub is the only remaining German sea unit, it can retreat to SZ 92.
If there are other German sea units surviving the combat, all German ships (that were part of the attack) have to retreat to SZ 104,
as only subs may pass through the Strait of Gibraltar regardless of which power controls it.
