ok the rules states that at no time can a fighter <or bomber> go on a kamikazi mission were there is no leagle way of landing.  dose removing the carier that they would have to land on as a casulty mean that it would be a kamikazi?

Since the planes could have landed on the carrier after the battle if you have not remove it as a casualty, the attack is legal and it's not considered kamikazi.  However, if the planes have no legal way to land after the battle in non-combat movement, they are lost.
